⚠️
Time-Sensitive Actions Required
Insurance claim deadlines are strictly enforced. Missing a deadline can forfeit your right to payment or legal action. Review all deadlines below and complete required actions immediately.
You must submit a sworn Proof of Loss statement with all supporting documentation (estimates, receipts, photos, inventories) to your insurance carrier. This is a formal legal document required by your policy.
⚠️ Consequences of Missing This Deadline:
Your claim may be denied entirely. The carrier can refuse to process or pay your claim if Proof of Loss is not submitted by the deadline specified in your policy (typically 60 days from loss date).
If your claim is denied, underpaid, or you cannot reach a fair settlement, you must file a lawsuit against your insurance carrier before this date. This deadline is set by your policy's "Suit Against Us" clause (typically 1-2 years from loss date, varies by state).
⚠️ Consequences of Missing This Deadline:
You permanently forfeit your right to sue your insurance company. Even if your claim was wrongfully denied or severely underpaid, you cannot take legal action after this date. Your only recourse is lost forever.
If you and your insurance carrier cannot agree on the amount of loss (not coverage disputes), either party may demand an appraisal under your policy terms. This is a binding dispute resolution process where independent appraisers determine the loss value.
ℹ️ When to Use Appraisal:
Appraisal is appropriate when the carrier acknowledges coverage but disputes the dollar amount of your loss. It cannot resolve coverage disputes (what is covered) or bad faith claims. Appraisal must be invoked before your suit limitation period expires.
Additional time-sensitive requirements:
- Notice of Loss: Must be reported "promptly" or within policy timeframe (typically 30-60 days)
- Cooperation Clause: You must cooperate with carrier's investigation, provide requested documents, and attend examinations under oath (EUO) when requested
- Supplemental Claims: Additional damage discovered later must be documented and submitted within policy timeframes
- Depreciation Recovery: Receipts for completed repairs must be submitted to recover withheld depreciation (typically within 180-365 days)
- State-Specific Deadlines: Some states impose additional deadlines for bad faith claims, unfair claims practices complaints, or Department of Insurance complaints
🛡️ Protecting Your Rights:
- Set calendar reminders for all critical deadlines with 7-day and 1-day advance warnings
- Document all communications with your carrier (dates, times, names, content)
- Send all important documents via certified mail with return receipt or email with read receipts
- Consult a public adjuster or attorney if you're approaching a deadline and haven't completed required steps
- Never assume a deadline can be extended without written confirmation from your carrier
